    Application Filing

    We file the trademark application with the Trade Marks Registry (online). You receive a TM number immediately upon filing and can use the ™ symbol from this point.

    Examination & Response

    The Registry examines the application and may raise objections. We draft and file a detailed response to any examination report within the prescribed time.

    Publication & Opposition

    If accepted, the mark is published in the Trade Marks Journal for a 4-month opposition period. We monitor for third-party opposition and respond if one is filed.

  6. 06

    Registration Certificate

    Once the opposition period passes without objection, the Registry issues the Registration Certificate — your trademark is now fully registered (®).

Frequently Asked Questions

Can I use ™ before my trademark is registered?

Yes. The ™ symbol can be used as soon as you file a trademark application, indicating that you claim rights in the mark. The ® symbol can only be used after the trademark is fully registered.

How long does trademark registration take in India?

The process typically takes 18–24 months from filing to registration, depending on the Registry's workload and whether any examination objections or oppositions arise. An expedited examination process is available for an additional fee, which can reduce the examination phase to a few months.

What is a trademark class?

The Nice Classification divides goods and services into 45 classes. A trademark is registered in the class(es) relevant to your business. For example, software products fall in Class 42; clothing in Class 25; legal services in Class 45. Filing in the wrong class gives you no protection in your actual area of business.

My competitor is using a name similar to mine. What can I do?

If your trademark is registered, you can initiate trademark infringement proceedings. If not registered, you may still have a remedy under the common law tort of "passing off" if you can prove prior use and goodwill. Contact us immediately — delay can weaken your position.

Is copyright registration mandatory?

No. Copyright in India arises automatically upon creation of an original work. However, registration creates a public record of ownership, which is valuable evidence in any dispute. We recommend registering copyright for important creative assets.
